Yet the timeline carries real costs. Uncertainty in the regulatory environment discourages investment on both sides. Creators cannot plan confidently knowing their copyright protections may shift substantially in 2026 or beyond. Technology companies cannot anchor expansion plans whilst the rules governing their core activity remain unresolved.The government said it needed more time to review the copyright and AI consultation responses, that it would be of no benefit to introduce 'piecemeal' legislation, and that it was of utmost importance not to rush to legislate 'before everything is in order'.

The honest acknowledgement is that Britain faces a genuine policy choice with no painless option. A licensing-first regime will slow AI development and cost the technology sector money in friction and compliance. A broad opt-out regime will expose creators to systematic use of their work without consent or compensation, threatening already-precarious income levels in creative professions. Neither course is costless, and reasonable people disagree on where the balance should tip.

What the government must resist is the temptation to delay indefinitely. Clarity, even imperfect clarity, serves better than perpetual deferral. The evidence is now in hand. By March 2026, ministers should have the economic analysis they require. What will follow must be a principled decision, not another commission of inquiry. The creative industries and technology sector have both articulated their positions with admirable clarity. The government now bears the responsibility to choose, explain that choice, and govern accordingly.
