Australia's own approach to AI in defence remains, to put it charitably, a work in progress. The Australian Signals Directorate and the Department of Defence have published guidance on AI governance, but nothing resembling a comprehensive legislative framework for how private AI tools can be used in sensitive government contexts. That gap is not unique to Australia; most democracies are in the same position. But the Anthropic-Pentagon dispute is a live demonstration of what happens when that governance vacuum meets a high-stakes commercial negotiation.

Strip away the talking points and what remains is a reasonably simple problem: governments need AI capabilities, AI capabilities are largely controlled by private firms, and neither side has worked out the terms of a durable relationship. The Pentagon's supply chain risk designation may be legally contestable, as Anthropic argues. But Anthropic's commercial interests are not the same as the public interest, and that distinction matters.

The sensible path forward, for Washington and for Canberra, is to invest in building clearer statutory frameworks that define what AI companies must provide to access government contracts, what governments can and cannot demand, and what the remedies are when negotiations break down. Resolving these disputes through ad hoc designations and public legal arguments is a poor substitute for policy. The technology is moving faster than the governance. That is the real supply chain risk.
